ARTICLE 227. Accidents in production subject to investigation and registration
The accidents, which happen to employees and other persons, [one] including those subject to mandatory social insurance [two] against accidents in production and occupational diseases, when [three] performing their labor duties and work assigned [four] by their organization or employer, which is a physical [five] person, are subject to investigation and registration.
To said [six] persons belong:
• employees doing jobs [seven] based on employment contracts ;
• students [eight] at educational establishments of higher professional and secondary vocational [nine] education, students at educational establishments of secondary, primary [ten] vocational education and educational establishments of general basic [one] education taking a practical work course in organizations; [two]
• persons sentenced to imprisonment and engaged to work [three] by the organization's management;
• other persons involved [four] in production activities of organizations or sole proprietors.
The [five] following cases shall be investigated and registered [six] as accidents in production: injuries, including those caused [seven] by other persons; acute poisoning; thermal strokes; [eight] burns; frost-bites; drowning; shock - electrical, from lightning [nine] or radiation; bites form insects and reptiles; injuries [ten] caused by animals; injuries, which have been [one] gotten as a result of explosions, accidents, destruction of buildings, [two] structures, and installations; natural calamities and other emergencies, [three] providing that they have caused the necessity [four] to transfer the employee to a different job, temporary or standing [five] loss of his ability to work or the employees' death, [six] if they have happened:
• during the working time [seven] in the premises of the organization or beyond them (including those, [eight] which occurred during the established intervals) and during [nine] the time required to bring in order the production tools [ten] and clothing prior to or after work, or when working [one] overtime, at weekends or work-free holidays;
• when [two] heading for the workplace or coming back using the transport [three] granted by the employer or his representative, or in one's vehicle, [four] if said vehicle is used for production purposes [five] by the employer's (or his representative's) instruction, or by agreement [six] between the parties to the employment contract;
• when [seven] going to the destination on a business trip or coming back; [eight]
• when driving a vehicle as a replacement driver [nine] during the rest between shifts (replacement driver, [ten] refrigerator unit attendant or mechanic on a train, etc.); [one]
• when working by camp method - during [two] the rest between shifts and staying on board of a ship [three] in the time free of watch and onboard service;
• [four] when the employee is assigned in line with [five] the established order to participate in elimination of the aftermaths of a disaster, [six] accident or other emergencies of natural or technical origin; [seven]
• when performing the actions, which are [eight] not part of the employee's labor duties, but carried [nine] out in favor of the employer or his representative, or aimed at prevention [ten] of an emergency or accident.
An accident in production is [one] an insurance case, if it has happened to an employee [two] subject to mandatory social insurance against accidents [three] in production and occupational diseases.
