ARTICLE 228. Employer's duties in case of an accident in production
If there is an accident in production, the employer or his [one] representative must do the following:
• immediately arrange [two] for first aid to the victim and his delivery to a health [three] care establishment, if necessary;
• take urgent [four] action to prevent the emergency situation from developing and involving [five] other persons by way of injuring factors;
• [six] until the investigation of the accident in production begins, secure [seven] the situation the way it was at the time of the accident, [eight] unless this endangers other people's life [nine] and health and leads to an emergency; and if it is not [ten] possible to secure it, take a record of the actual [one] situation (draw up sketches, take photographs [two] and other actions);
• provide for well-timed investigation [three] of the accident in production and its registration according to this [four] chapter;
• immediately inform the victim's relations [five] about the accident in production, also send e [six] message to agencies and organizations specified in this Code [seven] and other regulatory legal acts.
If an accident [eight] in production involves a group of people (two or more) [nine] or there is a heavy accident in production, or a fatal [ten] accident in production, the employer or his representative shall [one] advise within a day, respectively:
1. of an accident, which [two] took place in the organization:
• the relevant government [three] labor inspectorate;
• the prosecutor's office serving [four] the area, where the accident took place;
• [five] the federal executive power body, to which authority [six] the organization belongs;
• the Russian Federation's subject's [seven] executive power body;
• the organization, which [eight] had sent the employee, to whom the accident happened; [nine]
• the territorial associations of trade union organizations; [ten]
• the territorial government supervision agency, if the accident [one] took place in an organization or facility reporting to that [two] agency;
• the underwriter for mandatory social insurance [three] against accidents in production and occupational diseases;
2. [four] of an accident, which took place at an employer's, who [five] is a physical person:
• the relevant government [six] labor inspectorate;
• the prosecutor's office serving [seven] the area, where the employer, who is a physical [eight] person, is domiciled;
• the Russian Federation's [nine] subject's executive power body;
• the territorial [ten] government supervision agency, if the accident took place [one] in a facility reporting to that agency;
• the underwriter [two] for mandatory social insurance against accidents in production [three] and occupational diseases;
3. of an accident, which took [four] place on board of a vessel:
• the employer (the [five] ship-owner) and the relevant Russian Federation consulate, if the vessel [six] was sailing abroad. Having received the message [seven] about an accident, which had taken place [eight] on board of his ship, the ship-owner shall advise: [nine]
a) if the accident took place on board of a sea [ten] transport vessel:
o the relevant government labor inspectorate; [one]
o the transport prosecutor's office;
o the federal [two] executive power body managing sea transport [three] matters;
o the federal executive power body [four] authorized to implement the government safety control, when [five] the atomic energy is used, if the accident took [six] place at the ship's nuclear power plant or during [seven] the transportation of nuclear materials, radioactive substances or waste; [eight]
o the territorial associations of trade union organizations; [nine]
o the underwriter for mandatory social insurance against [ten] accidents in production and occupational diseases;
b) if the accident [one] took place on board of a fishing fleet vessel:
o [two] the relevant government labor inspectorate;
o the prosecutor's [three] office according to the place, where the vessel is [four] registered
o the federal executive power body [five] managing fishery matters;
o the territorial associations [six] of trade union organizations;
o the underwriter for mandatory [seven] social insurance against accidents in production and occupational [eight] diseases.
If there are cases of acute [nine] poisoning, the employer or his representative shall also [ten] advise the relevant sanitary & epidemiological supervision [one] agency.
