ARTICLE 412. Parties liabilities in the course of a strike
During the strike period the parties to a collective industrial [one] dispute shall be liable to continue the settlement [two] of such dispute through the conduct of conciliatory procedures.
The [three] Employer, executive bodies, local governments and the head [four] striking unit shall be liable to take [five] all possible measures in order to provide for public [six] order, property safety of organization (subsidiary, representative [seven] office, other separate structural subdivision) and employees [eight] during the strike period, as well as for the work of the machinery [nine] and equipment, which being suspended threaten to people`s [ten] life and health.
List of the minimum of required accomplishments [one] (services) in organizations, subsidiaries, representative offices, whose [two] activities are connected with people`s safety, [three] health support and essential public interests, shall [four] be produced and approved in each branch (sub-branch) [five] of economy by federal executive body authorized for coordination [six] and governing of activities in the respective branch (sub-branch) of economy, [seven] according to agreement with the respective Russian National [eight] Trade Union. In case there being existing [nine] several Russian National Trade Unions in any [ten] branch (sub-branch) of economy, a list of the minimum of required [one] accomplishments (services) shall be approved upon [two] agreement with each of the Russian National Trade [three] Unions existing in the branch (sub-branch) of economy. Procedures [four] of producing and approval of the minimum of required accomplishments (services) [five] shall be determined by the Government of the Russian Federation. [six]
The executive body of the subject of the Russian Federation [seven] shall produce and approve, on the basis of lists of the minimum [eight] of required accomplishments (services), produced and approved by the respective [nine] federal executive bodies, upon agreement with [ten] the respective territorial associations of trade union organizations [one] (trade unions associations), territorial lists of the minimum [two] of required accomplishments with the specification of the content and determination [three] of the minimum of required accomplishments (services) in the territory of the respective [four] subject of the Russian Federation.
The minimum of required accomplishments [five] (services) in organization, subsidiary, representative office shall [six] be determined upon agreement of the parties to collective [seven] industrial dispute in conjunction with a local government, [eight] on the basis of lists of the minimum of required accomplishments (services) [nine] within five days of the decision on calling a strike. [ten] The inclusion of any type of accomplishments (services) into the minimum [one] list, shall be justified by the fact of threat [two] to civilians health or life. The minimum of required accomplishments [three] (services) shall not include accomplishments (services) [four] which are not provided in the respective lists [five] of the minimum of required accomplishments (services).
In case of failure [six] to achieve agreement, the minimum of required accomplishments (services) [seven] in organization (subsidiary, representative office) shall be [eight] determined by the executive body of the subject of the Russian Federation.
The [nine] decision of such body to establish the minimum of required [ten] accomplishments (services) for organization, subsidiary, representative office, [one] can be appealed by the parties to collective industrial [two] dispute.
In case of failure to provide for the minimum of required [three] accomplishments (services) the strike shall be acknowledged [four] unlawful.
