ARTICLE 372. The procedure of consideration of opinion of an elective trade union body, representing an organization employees' interests when approving local bylaws, containing labor regulations
In cases, stipulated by this Code, employer submits [one] a draft of a local bylaw, containing labor regulations [two] and its substantiation to the elective trade union body, [three] representing the interests of all or the majority of employees of a given [four] organization, prior to making a decision.
Not later, than [five] in five working days, after the obtainment of the said [six] draft of local bylaw, the elective trade union [seven] body presents the employer with the motivated opinion, [eight] referring to the draft in written form.
In case the motivated [nine] opinion of the elective trade union body does [ten] not agree with the draft of a bylaw, or contains [one] suggestions on its improvement, the employer can either [two] agree with it, or must consult the elective [three] trade union body with the purpose of arriving [four] at mutually acceptable decision not later than [five] in three days after the obtainment of the motivated opinion.
In [six] case the decision in not reached, resulting disputes [seven] are entered on the records and the employer has the right [eight] to accept local bylaw, containing labor regulations, [nine] which can be appealed against in the respective [ten] state labor nspection or in court, while the elective [one] trade union body has the right to initiate [two] the procedure of a collective labor dispute, according to the procedure, [three] set by this Code.
Upon the obtainment of a claim (statement) [four] of the elective trade union body, state labor [five] inspection must carry out the check not later [six] than in a month after the obtainment of the claim and charge [seven] the employer with a binding directive, rendering the local [eight] bylaw ineffective in case any infringements are [nine] disclosed.
